1. Introduction & Acceptance

These Terms & Conditions ("Terms") govern your use of the Moonmap platform operated by Astronaut Party Inc. ("we," "us," or "our"). By creating an account or using our service, you agree to be bound by these Terms. If you do not agree, do not use the service.

2. Description of Service

Moonmap is a software-as-a-service (SaaS) platform that provides marketing analytics, cross-platform attribution, and campaign optimization tools. The service integrates data from third-party platforms including Meta Ads, Google Ads, Northbeam, and Shopify to deliver unified performance dashboards, creative intelligence, product profitability analysis, budget optimization, and AI-powered insights.

We reserve the right to modify, update, or discontinue features of the service at any time. We will make reasonable efforts to notify users of significant changes.

3. Account Registration & Security

• You must be at least 18 years of age to use the service.
• You must provide accurate and complete information when creating your account.
• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately of any unauthorized access to your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscription & Billing

4.1 Plans & Payment

• Access to the service requires a paid subscription unless otherwise agreed.
• Subscription fees are billed in advance on a recurring basis (monthly or annually, depending on your selected plan).
• All fees are quoted in U.S. dollars and are non-refundable except as required by law.

4.2 Cancellation

• You may cancel your subscription at any time through your account settings or by contacting us.
• Upon cancellation, your access will continue until the end of the current billing period.
• We do not provide prorated refunds for partial billing periods.

5. Permitted Use

You may use the service to:

• View, analyze, and export your marketing and e-commerce performance data.
• Generate reports and share them with authorized members of your organization.
• Connect supported third-party platforms to aggregate your business data.
• Use AI-powered insights and recommendations to inform your marketing decisions.

6. Prohibited Use

You agree not to:

• Share your login credentials with unauthorized individuals.
• Attempt to reverse engineer, decompile, or disassemble the service.
• Scrape, crawl, or use automated tools to extract data from the service.
• Use the service or any data obtained through it to build a competing product.
• Interfere with or disrupt the integrity or performance of the service.
• Use the service for any unlawful purpose or in violation of any applicable laws or regulations.
• Resell, sublicense, or redistribute access to the service without our written consent.

7. Third-Party Integrations

The service integrates with third-party platforms including Meta, Google, Northbeam, and Shopify. By connecting these platforms, you acknowledge and agree that:

• Your use of third-party platforms is subject to their respective terms of service and privacy policies.
• We are not responsible for the availability, accuracy, or performance of third-party platforms.
• Changes to third-party APIs or policies may affect the functionality of our service.
• You are responsible for maintaining valid credentials and permissions for connected platforms.
• We may access and store data from connected platforms as described in our Privacy Policy.

8. Intellectual Property

8.1 Our Property

The service, including its design, features, code, documentation, and branding, is owned by Astronaut Party Inc. and protected by intellectual property laws. Nothing in these Terms grants you any rights to our intellectual property except the limited right to use the service as described herein.

8.2 Your Data

You retain full ownership of your business data. We do not claim any ownership rights over data you provide or that is imported from connected third-party platforms. We use your data solely to provide the service as described in our Privacy Policy.

9. Data Ownership & Privacy

Your use of the service is also governed by our Privacy Policy, which describes how we collect, use, store, and delete your data. By using the service, you consent to the data practices described in the Privacy Policy.

You may request deletion of your data at any time by using the account deletion feature in the application or by emailing data@astronautparty.com. We will process deletion requests immediately upon receipt.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the service will be uninterrupted, error-free, or secure. We do not warrant the accuracy or completeness of any data, analytics, insights, or recommendations provided through the service. Marketing decisions made based on data from the service are your sole responsibility.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ASTRONAUT PARTY INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Astronaut Party Inc., its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the service, violation of these Terms, or infringement of any third-party rights.

13. Termination

• You may terminate your account at any time through the application or by contacting us.
• We may suspend or terminate your access if you violate these Terms or engage in conduct that we reasonably believe is harmful to the service or other users.
• Upon termination, your right to use the service ceases immediately.
• Data deletion upon termination is handled in accordance with our Privacy Policy.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising from these Terms or the service shall be resolved exclusively in the state or federal courts located in San Francisco, California.

15. Changes to These Terms

We may update these Terms periodically. We will notify you of material changes by:

• Posting the updated Terms on our website
• Updating the "Last Updated" date
• Emailing registered users for significant changes

Your continued use of the service after changes constitutes acceptance of the updated Terms.
